Terms of Service

1. Acceptance of Terms

By accessing or using Genesis Writer (“the Service”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, Acceptable Use Policy, and Cookie Policy. If you do not agree to these Terms, you may not use the Service. We may update these Terms from time to time as described in Section 11 (Changes to Terms): we will provide notice of material changes and give you an opportunity to cancel before they take effect, and your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.

2. Account Registration & Eligibility

• You must be at least 18 years old to create an account or use the Service. By registering, you represent and warrant that you are at least 18 years of age.
• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate and complete information during registration.
• One account per person. Creating multiple accounts to abuse free tiers or promotions is prohibited.
• You are solely responsible for all activity that occurs under your account.
• If we learn that an account belongs to a person under 18, that use is unauthorized and we may terminate the account. A false age representation does not entitle you to a refund.

3. Subscription Plans & Billing

• Free Plan: A free plan that includes a one-time grant of Genesis Tokens and limited features. No credit card required. Current token allowances are shown on our Pricing page.
• Paid Plans: Our Basic, Writer, and Professional plans are billed monthly. Current prices and token allowances are shown on our Pricing page and confirmed at checkout before you pay.
• Automatic Renewal: Paid subscriptions renew automatically each billing cycle. You may cancel at any time from your account settings.
• Token Resets: Paid plan tokens reset at the beginning of each 30-day billing cycle. Unused tokens do not roll over.
• Price Changes: We may adjust pricing with 30 days advance notice. Existing subscribers will be notified by email before any price increase takes effect.
• Payment Processing: All payments are processed by Stripe, a PCI DSS Level 1 certified payment processor. Genesis Writer does not store, process, or have access to your full credit card number, CVV, or expiration date. By subscribing, you also agree to Stripe’s Services Agreement.
• Renewal Disclosure & Cancellation: Renewal terms (the price and billing cycle) are presented clearly before you complete checkout, and completing your purchase is your affirmative consent to recurring charges until you cancel. You can cancel online at any time from your account settings; cancellation takes effect at the end of the current billing period.

4. Refund Policy

We offer a 3-day money-back guarantee on all paid subscription plans, subject to the following conditions:

• Time Window: Refund requests must be submitted within 3 calendar days of the subscription purchase date.
• Usage Threshold: You must have only minimally used the Service’s AI features during the current billing period. Refund requests may be declined where your usage indicates the plan was substantially consumed. This lets you genuinely evaluate the platform while protecting against abuse.
• How to Request: Contact our support team at support@genesiswriter.ai with your account email and reason for the refund.
• Processing: Approved refunds are processed within 5–10 business days and returned to the original payment method.
• Exclusions: Refund requests that exceed the 3-day window, or where usage indicates the plan was substantially consumed, will not be honored. Partial refunds are not available.

Disputes & Chargebacks: If there’s a payment dispute, we’re happy to work with you to resolve it — just reach out to our support team. In the event of a formal chargeback, we may provide detailed usage records (timestamps, token consumption, feature usage, and model selection) as evidence of service delivery.

EU / UK Consumers — Right of Withdrawal: If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, you normally have a 14-day right of withdrawal under the Consumer Rights Directive (Directive 2011/83/EU) and equivalent UK legislation. Genesis Writer is a digital service that begins performing immediately upon subscription. By subscribing and starting to use the Service, you expressly request that performance begin during the withdrawal period and you acknowledge that you lose your right of withdrawal once performance has begun. Where mandatory consumer-protection law in your country grants you broader refund rights than those described in this section, those mandatory rights apply.

5. Genesis Token System

• Genesis Tokens are a virtual currency used to access AI features within the Service.
• Tokens have no monetary value outside of the Service and cannot be transferred, sold, or exchanged.
• Token costs vary by AI model and feature. More capable models consume more tokens per generation.
• We reserve the right to adjust token pricing for individual models as AI provider costs change.
• First-time subscriber bonuses (a one-time extra grant of base tokens for first-time subscribers, as described on our Pricing page) are applied to your first billing cycle only. They reset with your billing cycle and do not recur. If you cancel and re-subscribe to the same tier, the first-month bonus is not granted again.
• Bonus tokens awarded through promotions or coupons do not expire and are consumed after base tokens.

6. AI-Generated Content & Intellectual Property

• Your Content: You retain ownership of all content you create, including text you write and content you generate using AI features.
• AI Outputs: Content generated by AI models is provided as a creative tool. You are responsible for reviewing, editing, and ensuring the quality and accuracy of AI-generated content before use.
• Copyright Status: Under current United States law, purely AI-generated content may not qualify for copyright protection. Copyright generally requires human authorship. You are responsible for contributing sufficient original creative expression to any AI-assisted work if you wish to claim copyright protection. Genesis Writer makes no representation regarding the copyrightability of AI-generated outputs.
• Non-Uniqueness: AI models may produce similar or identical outputs for different users who provide similar inputs. Genesis Writer does not guarantee that AI-generated content is unique to you.
• No IP Indemnification: Genesis Writer does not indemnify you against third-party intellectual property claims arising from AI-generated content. You are solely responsible for ensuring that your use of AI-generated content does not infringe the rights of others.
• No Guarantees: AI-generated content may contain errors, inconsistencies, or biases. Genesis Writer does not guarantee the accuracy, originality, or fitness for purpose of AI outputs.
• License to Us: By using the Service, you grant Genesis Writer a limited, non-exclusive license to host, store, back up, transmit, display back to you, and process your content (including through our AI providers) solely to operate, secure, and provide the Service. Based on our providers’ current paid-API terms, neither we nor our AI providers use your content to train or fine-tune AI models.
• Downstream Restrictions: You may not use AI-generated content from Genesis Writer to train, fine-tune, distill, or otherwise develop competing AI models or services.

7. Prohibited Use

Your use of Genesis Writer is subject to our Acceptable Use Policy, which provides detailed content guidelines and prohibited uses. In summary, you agree not to use the Service to:

• Generate content that violates applicable laws or regulations.
• Create, distribute, or promote content involving the exploitation of minors.
• Harass, threaten, or defame any individual or group.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use automated scripts, bots, or scraping tools to access the Service.
• Create multiple accounts to circumvent usage limits or exploit free tiers.
• Share, resell, or sublicense your account access to third parties.
• Intentionally submit prompts designed to bypass content safety systems.

8. Service Availability & Modifications

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• AI model availability depends on third-party providers and may change without notice.
• We may modify, suspend, or discontinue features at any time with reasonable notice when possible.
• Scheduled maintenance will be communicated in advance when feasible.

9. Disclaimer of Warranties & Limitation of Liability

Disclaimer of Warranties. THE SERVICE AND ALL AI-GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI outputs will be accurate, original, or fit for any purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

To the maximum extent permitted by law, Genesis Writer and its owner, employees, contractors, agents, suppliers, and licensors (collectively, the “Genesis Parties”) shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, or business opportunities arising from use of the Service.
• Content generated by AI models, including any claims of plagiarism, inaccuracy, or harm.
• Service interruptions caused by third-party providers or force majeure events.

The aggregate liability of the Genesis Parties for any claim arising from your use of the Service shall not exceed the greater of (a) the amount you paid to Genesis Writer in the 12 months preceding the claim, or (b) US $100.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, gross negligence, willful misconduct, or death or personal injury caused by negligence. The limitations in this section apply only to the extent permitted by law.

10. Termination

• You may cancel your subscription and delete your account at any time from your account settings.
• We may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy, with or without prior notice.
• Upon termination, your right to access the Service ceases immediately. While your account is active you can download a complete archive of your content at any time from your account settings; after termination you may request an export by contacting support within 30 days. After 30 days, your data will be permanently deleted.
• If you delete your account while on an active paid subscription, your subscription will be canceled immediately. Except where you qualify for the 3-day money-back guarantee described in Section 4, no refund will be issued for the remaining time in your current billing period.
• Provisions relating to intellectual property, limitation of liability, indemnification, and disputes survive termination.

11. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you disagree with any changes, you may cancel your subscription before the changes take effect.

12. Governing Law & Dispute Resolution

• Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
• Informal Resolution: Before initiating any formal dispute proceeding, you agree to first contact us at support@genesiswriter.ai and attempt to resolve the dispute informally for at least 30 days.
• Binding Arbitration: If a dispute cannot be resolved informally, it shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Illinois or, at your election, by telephone or online. The arbitrator’s decision is final and binding.
• Class Action Waiver: You agree that disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
• Small Claims Exception: Either party may bring an individual action in small claims court for disputes within that court’s jurisdictional amount.
• Injunctive Relief: Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for violations of intellectual property rights or confidentiality obligations.
• Arbitration Costs: For any arbitration you commence, we will pay the AAA filing, administrative, and arbitrator fees to the extent required by the AAA Consumer Arbitration Rules. Each party otherwise bears its own attorneys’ fees and costs, except as the arbitrator may award under applicable law.
• Right to Opt Out: You may opt out of this arbitration agreement and the class-action waiver by emailing support@genesiswriter.ai within 30 days of first accepting these Terms, stating your name, account email, and intent to opt out. Opting out does not affect any other provision of these Terms.
• Coordinated Arbitrations: If 25 or more similar arbitration demands are filed by or with the coordination of the same or coordinated counsel, the demands will be administered in staged batches (with a limited number of “bellwether” cases resolved first) to promote efficiency, and applicable limitations periods will be tolled for the remaining demands during batching.
• Severability of This Section: If the class-action waiver is found unenforceable as to any claim or remedy, that claim or remedy will be severed and resolved in a court of competent jurisdiction while the remainder of this arbitration agreement continues to apply; an arbitrator may not preside over any class, consolidated, or representative proceeding.
• Exclusive Venue for Court Matters: For any claim not subject to arbitration (including small-claims and injunctive-relief actions) and for any action to confirm or enforce an arbitration award, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Illinois.

13. Indemnification

You’re responsible for how you use Genesis Writer. If any legal claims arise from your use of the Service, you agree to cover Genesis Writer’s reasonable costs and damages related to:

• Your use or misuse of the Service.
• Violations of these Terms or applicable laws.
• Your content, including any intellectual property claims arising from AI-generated content you publish or use commercially.
• Third-party claims related to your use of the Service.

We will notify you of any claim subject to this indemnity, and we may, at our option, assume the exclusive defense and control of the matter (at your expense) using counsel of our choice. You agree to cooperate with our defense, and you may not settle any claim in a way that imposes any obligation or admission on Genesis Writer without our prior written consent. This indemnity applies only to the extent permitted by applicable law and not where mandatory consumer-protection law prohibits shifting such costs to a consumer.

14. Third-Party Services

Genesis Writer relies on third-party services to provide its functionality. We are not responsible for the availability, accuracy, or content of third-party services, and your use of them may be subject to their own terms and policies:

• AI Providers: We use multiple third-party AI providers for text generation and image creation. The specific providers and models available may change over time. Outages or changes by these providers may affect service availability.
• Payment Processing: All payments are processed by Stripe. See Stripe’s Services Agreement.
• Cloud Infrastructure: We use industry-standard cloud providers for authentication, database, and file storage.

15. Image Generation

• Character portrait images are generated using third-party AI image generation services.
• AI-generated images may not qualify for copyright protection under current US law, as they are produced by AI without direct human authorship of the visual output.
• You may use generated images within your Genesis Writer projects for personal and commercial purposes, subject to these Terms.
• Image generation is subject to content safety filters. Attempting to generate explicit, harmful, or illegal imagery is a violation of our Acceptable Use Policy.

16. Force Majeure

Genesis Writer shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, government actions, pandemic or epidemic, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including AI providers, cloud infrastructure, and payment processors).

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, Acceptable Use Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and Genesis Writer regarding the Service.
• Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: The failure of Genesis Writer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. Genesis Writer may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Notices: Notices to you may be sent to the email address associated with your account. Notices to Genesis Writer should be sent to support@genesiswriter.ai, with a copy to the notice address in Section 18.
• Feedback: If you send us suggestions or feedback about the Service, you grant Genesis Writer a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
• Beta & Pre-Release Features: Some features may be offered on a beta or pre-release basis, provided “as is” without warranties, and may be changed or withdrawn at any time.
• Export & Sanctions Compliance: You represent that you are not located in, and will not use the Service from, any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party or denied-party list.

The Service is operated from the State of Illinois, United States, currently as a sole proprietorship. Our registered legal entity name and a physical notice address will be published here upon incorporation, which we are completing before public launch.
