1. Overview

Genesis Writer respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), codified at 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using the Genesis Writer platform. Information you submit in a notice or counter-notification (including your contact details) is processed to handle the claim, forwarded to the opposing party as the law requires, and retained in accordance with our Privacy Policy.

3. Filing a Takedown Notice

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement on Genesis Writer, please submit a written notification to our DMCA Agent containing the following information, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  3. Identification of the material that is claimed to be infringing, including sufficient information for us to locate it (such as URLs, project descriptions, or user identifiers).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner.

Incomplete notices may not be acted upon. Knowingly submitting a false or misleading DMCA notice may result in liability under 17 U.S.C. § 512(f).

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the material, and we will take reasonable steps to notify the affected user that their material was removed — forwarding a copy of the notice (including the information it contains) so they may submit a counter-notification if appropriate.

4. Counter-Notification

If you believe that material you posted on Genesis Writer was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Genesis Writer may be found), and that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we will promptly forward it (including the information it contains) to the original complainant. We will restore the removed material in not less than 10, and not more than 14, business days after we receive the counter-notification, unless our designated agent first receives notice that the complainant has filed a court action seeking to restrain the allegedly infringing activity.

Knowingly materially misrepresenting that material was removed or disabled by mistake or misidentification may result in liability under 17 U.S.C. § 512(f).

5. Repeat Infringer Policy

Genesis Writer maintains a record of copyright-infringement notices associated with each account and, in appropriate circumstances, will suspend or permanently terminate the accounts of users who are repeat infringers. A user who accumulates repeated valid infringement notices may have their account terminated.

6. AI-Generated Content

Genesis Writer uses AI models to assist users in generating creative writing. AI-generated text may occasionally resemble existing copyrighted works. You are solely responsible for reviewing all AI-generated content before publishing or distributing it. Allocation of liability for AI-generated content is governed by the AI-Generated Content, warranty-disclaimer, limitation-of-liability, and indemnification provisions of our Terms of Service.
