1. Overview

Genesis Writer respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), codified at 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using the Genesis Writer platform.

3. Filing a Takedown Notice

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement on Genesis Writer, please submit a written notification to our DMCA Agent containing the following information, as required by 17 U.S.C. § 512(c)(3):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
3. Identification of the material that is claimed to be infringing, including sufficient information for us to locate it (such as URLs, project descriptions, or user identifiers).
4. Your contact information, including name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner.

Incomplete notices may not be acted upon. Knowingly submitting a false or misleading DMCA notice may result in liability under 17 U.S.C. § 512(f).

4. Counter-Notification

If you believe that material you posted on Genesis Writer was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent containing:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Genesis Writer may be found), and that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the removed material within 10 to 14 business days, unless the complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat Infringer Policy

Genesis Writer maintains a policy of terminating the accounts of users who are repeat infringers of copyright in appropriate circumstances. If a user is found to have repeatedly posted infringing material, their account may be suspended or permanently terminated at our discretion.

6. AI-Generated Content

Genesis Writer uses AI models to assist users in generating creative writing. AI-generated text may occasionally produce content that inadvertently resembles existing copyrighted works. Users are solely responsible for reviewing all AI-generated content before publishing or distributing it. Genesis Writer is not liable for any similarity between AI-generated outputs and existing copyrighted material, and any such resemblance is unintentional.
