Welcome to the Genesis Affiliate Program! We’re excited to partner with you. These terms outline how the program works, what you can expect from us, and what we ask of you. We’ve tried to keep things clear and straightforward.
Effective Date: These terms are effective upon your acceptance when joining the Genesis Affiliate Program.
1. Program Overview
The Genesis Affiliate Program lets you earn commissions by sharing Genesis Writer with others. When someone signs up through your referral link and subscribes to a paid plan, you earn a percentage of their subscription — for as long as they remain a subscriber. By participating in this program, you agree to these terms.
2. Commission Structure
- Commission Rate: 20% of the subscription amount paid by referred customers.
- Lifetime Recurring: You continue to earn commission for as long as the referred customer maintains an active paid subscription.
- Payment Timing: Commissions are paid monthly, following a Net-30 hold period from the date the commission is earned.
- Minimum Payout: The minimum payout threshold is $10. Once your available balance reaches $10, commissions will be included in the next monthly payout cycle.
3. Referral Attribution
- Cookie Duration: Referrals are tracked via a 90-day cookie. If a referred user signs up within 90 days of clicking your referral link, they will be attributed to you.
- One-Time Attribution: Each user can only be attributed to one affiliate. Attribution uses a last-click model: if a user clicks multiple affiliate links, the most recent click within the 90-day window determines attribution. Once a user has converted, they cannot be re-attributed.
- Conversion: A referral is considered "converted" when they subscribe to any paid plan.
4. Playing Fair
To keep the program honest and beneficial for everyone, please avoid the following:
- Self-Referrals: Please don’t use your own referral link or code to sign up for accounts or subscriptions.
- Fraud: Fraudulent activity — such as creating fake accounts or manipulating the referral system — may result in removal from the program and forfeiture of unpaid commissions.
- Misrepresentation: Please represent Genesis Writer, its features, and the affiliate program accurately.
- Spam: Don’t send unsolicited emails, messages, or engage in spam marketing. It hurts everyone’s reputation, including yours.
- Trademark Usage: Please don’t bid on Genesis Writer branded keywords in paid advertising without checking with us first.
5. FTC Disclosure Requirements
Good to know — this protects both you and your audience
The U.S. Federal Trade Commission (FTC) requires affiliates to disclose their relationship when promoting products. This is standard practice for all affiliate programs and helps maintain trust with your audience. Here’s what you need to do:
- Be Transparent: Use clear language like "I earn a commission if you purchase through this link" or "This is an affiliate link — I may earn a commission at no extra cost to you."
- Place It Prominently: Disclosures should appear before or alongside your affiliate link, not buried at the bottom of a post.
- Every Platform: This applies wherever you promote Genesis — blogs, YouTube, Instagram, TikTok, Twitter, podcasts, newsletters, and any other medium.
- Be Specific: Just using "#affiliate" or "#ad" alone isn't enough — add a brief explanation of your relationship.
- Mobile-Friendly: Make sure disclosures are visible on mobile devices without extra scrolling or clicks.
6. Respecting User Privacy
We take privacy seriously, and we ask our affiliates to do the same. Please follow applicable data privacy laws (GDPR, CCPA, etc.) in your promotional activities:
- Data Collection: You may not collect personal data from referred users beyond what is necessary for referral tracking.
- Privacy Notices: If you collect any user data as part of your promotional activities, you must provide appropriate privacy notices.
- Data Requests: You must honor data access and deletion requests from referred users in accordance with applicable laws.
- No Data Selling: You may not sell, rent, or share personal data of referred users with third parties.
7. Email Marketing Compliance (CAN-SPAM)
If you promote Genesis via email, you must comply with the CAN-SPAM Act and similar laws:
- Unsubscribe Mechanism: All promotional emails must include a clear and functional unsubscribe mechanism.
- Opt-Out Requests: You must honor unsubscribe requests within 10 business days.
- No Purchased Lists: You may not use purchased or rented email lists to promote Genesis.
- Accurate Headers: Email headers (From, To, Reply-To) must be accurate and not misleading.
- Physical Address: Promotional emails must include your valid physical postal address.
8. Your Status as an Affiliate
As an affiliate, you’re an independent partner — not an employee, agent, or representative of Genesis Writer. This means you have the freedom to promote Genesis on your own terms, but it also means you’re responsible for:
- Your own taxes, including self-employment taxes
- Your own business expenses
- Your own insurance and liability coverage
- Any local business licensing requirements that may apply
Since this is an independent partnership, Genesis Writer doesn’t provide employment benefits to affiliates.
9. Intellectual Property
- Limited License: Genesis Writer grants you a limited, non-exclusive, revocable license to use Genesis trademarks and brand assets solely for promoting Genesis as an affiliate.
- Brand Guidelines: You must use Genesis branding in accordance with any brand guidelines we provide.
- No Modification: You may not modify, alter, or create derivative works from Genesis logos or brand assets.
- No Domain Registration: You may not register domain names containing "Genesis", "GenesisWriter", "Genesis Writer", or similar variations.
- Termination: Upon termination of your affiliate status, you must immediately cease all use of Genesis trademarks and brand assets.
10. Responsibility for Your Promotions
Since you independently promote Genesis Writer, you’re responsible for how you do it. If any legal issues arise from your promotional activities, you agree to cover Genesis Writer’s reasonable costs and damages related to:
- Your promotional activities as an affiliate
- Any breach of these terms
- Non-compliance with applicable laws (FTC, CAN-SPAM, GDPR, CCPA, etc.)
- Inaccurate or misleading claims about Genesis Writer
- Third-party claims arising from your affiliate activities
11. Commission Adjustments
- Refunds: If a referred customer requests and receives a refund, the associated commission will be reversed.
- Chargebacks: If a referred customer's payment results in a chargeback, the associated commission will be reversed.
- Subscription Cancellation: Commissions cease when a referred customer cancels their subscription.
12. Payment Methods
Payouts are processed via Stripe Connect. You will need to connect your Stripe account in the affiliate dashboard to receive payouts. Payments are initiated by our team on a monthly basis and deposited directly to your linked bank account.
13. Tax Compliance
You are responsible for reporting and paying any taxes on affiliate earnings in your jurisdiction.
- US Affiliates: Genesis Writer is required to issue IRS Form 1099-NEC if you earn $2,000 or more in a calendar year (per IRS Notice 2024-85, effective 2026). You may be required to submit a W-9 form before we can process your first payout.
- International Affiliates: You may be required to submit a W-8BEN form to certify your foreign status. If you do not provide required tax documentation, we may be required to withhold up to 30% of your earnings for US tax purposes.
- Tax Forms: You will be notified when tax documentation is required, and must submit it before payouts can be processed.
14. Program Changes
Genesis Writer reserves the right to modify these terms, commission rates, or any aspect of the affiliate program at any time. We will provide at least 30 days advance notice of changes to commission rates via email. Other significant changes will be communicated via email or through the affiliate dashboard. Continued participation in the program after such changes take effect constitutes acceptance of the modified terms.
15. Leaving the Program
You’re free to leave the affiliate program at any time — no hard feelings. Genesis Writer may also end the partnership if these terms are violated. If either side ends the relationship:
- Your referral link and code will be deactivated.
- You’ll still receive payment for any earned and available commissions.
- Pending commissions (within the Net-30 hold period) will be paid out after the hold period, as long as there are no reversals.
16. Limitation of Liability
If something goes wrong on our end, our responsibility is limited to any unpaid commissions we owe you. We can’t be held liable for indirect or consequential damages related to your participation in the program.
17. Governing Law
These Affiliate Program Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the dispute resolution procedures described in our Terms of Service (Section 12).
